NEW YORK (AP) — A May 5 trial date was set Thursday in Sean “Diddy” Combs’ sex trafficking case, and a prosecutor argued that the jailed hip-hop mogul’s lawyers were trying to exclude a “damning piece of evidence” by claiming it was leaked by the government.
Assistant U.S. Attorney Emily Johnson struck back against the defense’s claims during Combs’ first appearance before Manhattan federal court Judge Arun Subramanian, who will preside over his trial. Combs’ mother flew in from Florida for the proceeding, sitting behind him with his children and other family members in the courtroom gallery.
Johnson took issue with the defense lawyers’ argument in a submission late Wednesday that the U.S. Department of Homeland Security leaked a video to the media of Combs punching and kicking his former protege and girlfriend, the R&B singer Cassie, in a Los Angeles hotel hallway in 2016.
Combs’ lawyers said the video, aired by CNN in May, and other alleged government leaks “have led to damaging, highly prejudicial pretrial publicity that can only taint the jury pool and deprive Mr. Combs of his right to a fair trial.”
But Johnson urged the judge to see through the defense claims, calling them “baseless and simply a means to try to exclude a damning piece of evidence” from the trial.
“Not a single one of those alleged leaks are from members of the prosecution team,” Johnson said.
Still, Subramanian told defense lawyer Marc Agnifilo to write a proposed order that he would sign instructing lawyers on both sides to comply with rules prohibiting them from publicly disclosing information that could taint a jury.
The prospective order would also restrict what both sides can publicly say about the case — something Johnson said was necessary after Agnifilo characterized Combs’ indictment in a TMZ interview last month as a “takedown of a successful Black man.”
Combs, 54, has pleaded not guilty to racketeering conspiracy and sex trafficking charges alleging he coerced and abused women for years with help from a network of associates and employees while silencing victims through blackmail and violence, including kidnapping, arson and physical beatings.
Johnson reasserted that the indictment could be updated to add charges or defendants.
Combs, wearing a beige jail jumpsuit, was more engaged and animated during Thursday’s hearing than he had been at two earlier court appearances. When he entered the courtroom, he gave a hearty hug to each of his lawyers and smiled as he spoke with them.
During the proceeding, he turned to attorney Anthony Ricco and whispered in his ear, as Johnson spoke about electronic materials seized from his residences and from him during his arrest.
Ricco said outside the courthouse afterward that Combs is making the best of a difficult situation.
“Dr. King called it the law of unintended consequences,” he said, referring to civil rights leader Martin Luther King. “Sometimes the more you push a person down, the stronger they get.”
Johnson said 96 electronic devices were seized in raids in March on Combs’ residences in Miami and Los Angeles and at an unspecified private airport in Florida. She said another four devices were seized when Combs was arrested last month.
She said eight devices seized in Miami contained over 90 terabytes of information, which she labeled as “extraordinary” as she explained delays in extracting some information for technological reasons.
The judge said Combs can return to court in December unless lawyers agree that hearing is unnecessary.
Much of the hearing featured arguments by lawyers about what is needed to protect an eventual jury from bias, highlighted by Johnson’s claims about the hotel video.
After the video was broadcast, Combs posted a social media video apologizing, saying: “I was disgusted when I did it” and “I’m disgusted now.”
Responding Wednesday night in a court filing to defense claims that the federal government had leaked the video to CNN, prosecutors told the judge that the government was not in possession of the video before it was aired on CNN.
After the video aired, Combs apologized, saying, “I was disgusted when I did it.” His lawyers have described the episode as a lovers’ quarrel. In Combs’ indictment, prosecutors allege he tried to bribe a hotel security staffer to stay mum about the video.
Combs’ lawyers have been trying unsuccessfully to get the Bad Boy Records founder freed on bail. He has been held at a federal jail in Brooklyn since his Sept. 16 arrest.
Two judges have concluded that Combs would be a danger to the community if he is released from the Metropolitan Detention Center, a facility that has been plagued by violence and dysfunction for years. At a bail hearing three weeks ago, a judge rejected a $50 million bail package, including home detention and electronic monitoring, after concluding that Combs was a threat to tamper with witnesses and obstruct a continuing investigation.
In the meantime, Agnifilo said: “We’re making a go of the MDC. The MDC has been very responsive for us.”
In an appeal of the bail rulings to the 2nd U.S. Circuit Court of Appeals, lawyers for Combs on Tuesday asked a panel of judges to reverse the bail findings, saying the proposed bail package “would plainly stop him from posing a danger to anyone or contacting any witnesses.”
They urged the appeals court to reject the findings of a lower-court judge who they said had “endorsed the government’s exaggerated rhetoric and ordered Mr. Combs detained.”

But the response they received from the gathered crowds was more warm than their grandmother’s – as they were told to ‘stick together’ and their guardian was demanded: ‘look after those girls’.
Diddy entered the courtroom via a side door today, wearing prison clothing. He smiled and hugged his lawyers as he went into the room.
The judge offered Diddy a trial date on May 5, on the request of his legal team. Prosecutors said they estimate their cause will take about three weeks, while Combs’ lawyers say they’ll need about a week to make their case.
He will remain behind bars as he waits for the trial, despite surrendering his passport, selling his private jet and offering up his $48 million home to secure bail.
They further filed a motion for an evidentiary hearing, accusing the government of leaking sensitive information from the case.

In a statement to the judge on Thursday afternoon, the government responded: ‘We have concerns about Mr Agnifilo’s statement.
‘He baselessly accused the government of engaging in a racist prosecution.’
Cassie could still be called to testify as a star witness during the upcoming trial, despite allegedly signing a non disclosure agreement.
The singer settled a suit with Diddy in November 2023, but her coming forward is widely considered a catalyst in further investigations into Diddy’s behavior.
In her lawsuit, Cassie claimed that Diddy brutally beat and sexually abused her for over a decade throughout their tumultuous relationship.

During the searches of Combs’ homes earlier this year, law enforcement seized narcotics, videos of the performances and more than 1,000 bottles of baby oil and lubricant, according to prosecutors.
They said agents also seized firearms and ammunition, including three AR-15s with defaced serial numbers in his bedroom closet in Miami.
Janice continued, ‘Watching the world make jokes and laugh at my son’s life crumbling before our eyes is something I can never forget.
‘It is truly agonizing to watch the world turn against my son so quickly and easily over lies and misconceptions, without ever hearing his side or affording him the opportunity to present his side.’
She said that ‘like every human being, my son deserves to have his day in court, to finally share his side, and to prove his innocence.’

‘Discovery in this case is voluminous, totaling several terabytes of electronic material,’ the government argued in the latest filing.
There are 1,000 gigabytes per terabyte of data, meaning the government is currently sifting through thousands of gigabytes worth of potentially crucial information.
This includes cellphones, laptops, tablets, hard drives, cloud accounts from both Diddy and third parties.
Additionally, prosecutors are scouring business records from financial institutions, phone companies, hotels and airlines as they build their case.
Lawyers for Diddy said: ‘We understand that the government seized a significant amount of Mr. Combs’ electronic devices and data pursuant to search warrants that were executed on March 25, 2024.
‘The government also seized additional devices belonging to Mr. Combs at the time of his arrest about three weeks ago.
‘The timely production of these materials is critical to Mr. Combs’ ability to prepare his defense.’
His lawyers argued that because the devices in question ‘belong to Mr Combs, their production should not be delayed by the government’s initial review for responsiveness and privilege.
‘The government has indicated they will be able to produce these devices in the next 30 days.’
The government has argued it will take days to even copy the data from the devices ‘due to the volume of materials’, but has vowed to ‘make rolling productions within the next thirty days of hard drives that were seized from the defendant.’
In the filing, the government said it hopes to hand over all discovery by the end of the year.
An attorney representing Diddy’s accusers said his phone was ringing off the hook with people wanting to share their own horror stories.
In all, he has about 120 clients – 25 of whom say they were minors at the time the alleged offending took place.
He’s also gearing up to name other high-profile people who could soon be caught up in the allegations.
‘We want to make sure if we name individuals beyond Mr Combs that we have done our homework because it is going to create a firestorm, and we understand that.
‘If you were there in the room, participated, watched it happen and didn’t say anything or helped cover it up, in my view, you have a problem.’
Buzbee vowed to pursue the cases against any offender ‘aggressively’, and said the scope was broad.
In the wake of his arrest, all of Diddy’s celebrity friendships have been under scrutiny. Photographs from his infamous parties have resurfaced, with guests and witnesses speaking out about the debauchery which often took place.
Buzbee previously said people would be ‘shocked’ by the names he’s heard during the course of his investigation.

This is the “Chief of sinners,” Daniel Whyte III, president of Gospel Light Society International, with the Gospel Light Minute X Podcast #447 titled, “The Big Question” I’m here to remind you of what the Bible says, that “Christ Jesus came into the world to save sinners” like you and me.
“HAVE YOU BEEN BORN AGAIN?”
The question is not “Have you joined a church?” or “Are you trying to do your best?” or “Do you have religion?” but “Are you twice-born?” Jesus Christ said in John 3:3, “Except a man be born again, he cannot see the kingdom of God”.
We enter the physical world by birth. Spiritual life likewise is entered with a birth. We become members of a human family by birth; we become members of the family of God by birth, by being “born again.” There is no other way to get into the human family except by birth, and there is no other way to get into God’s family except by the new birth. Neither education, nor cultivation, nor reformation, nor “turning over a new leaf,” will accomplish this. What is needed is not a new “leaf” but a new “life”! “Ye must be born again” (John 3:7).
A New Nature Needed
By physical birth we become partakers of human nature; by being born again we become “partakers of the divine nature”. A Christian is the product of a divine “begetting”. The second birth is not an improvement of the old nature; it is the imparting of an entirely new nature. The old nature is hopelessly corrupt and incapable of ever being made fit for His presence. The new birth requires a creative act of the Holy Spirit. “If any man be in Christ, he is a new creature”.
Not “Trying” But “Trusting”
“Trying to follow Christ” is not Christianity. Christianity is not imitation of Christ, it is the indwelling of Christ. Christianity is not trying to do anything. It is trusting Christ Who has done it all! He has “finished the work” and there is nothing left to do but simply to receive and trust Him. He shed His precious blood on the cross and the work is all done once and forever! Cease trying and begin trusting! Believers will progressively become more and more like Christ, but by His power, not their own.
What Must I Do To Be Saved?
Simply “Believe on the Lord Jesus Christ”. The Bible says in 1 John 5:1, “Whosoever believeth that Jesus is the Christ is born of God”. The Bible states in John 1:12,13, “As many as received him, to them gave he power to become the sons of God, even to them that believe on his name: Which were born, not of blood, nor of the will of the flesh, nor of the will of man, but of God”.
You are born again, you become a Christian by trusting a Person—receiving a Person. The very moment you do this, the Lord Jesus Christ comes in and life begins!
What Is Meant By “Believe”?
To “believe on the Lord Jesus Christ” means more than simply believing the historic facts concerning Him. Intellectual belief about Christ is not sufficient. The belief that brings salvation must be “with the heart,” that is, with the whole being. This belief also includes repentance: “Repentance toward God, and faith toward our Lord Jesus Christ”. The Bible states in Acts 17:30, “God … now commandeth all men every where to repent”.
The faith which saves, then, includes the necessity to repent, and to receive Christ as Saviour and Lord, to rest upon Him alone for salvation. It means to trust Him so utterly and completely that, if He should fail, there would be no hope at all!
May I Know That I Am Born Again?
This is an important question. We know that we are born again by the testimony of God’s Word. God says in John 5:24, “He that heareth my word, and believeth on him that sent me, hath everlasting life, and shall not come into condemnation; but is passed from death unto life”. Have you believed on the Lord Jesus Christ as explained by God’s Word? If so, then you are saved, you are “born again,” you have “passed from death unto life.” God says so! Take God at His Word, and go on your way rejoicing!
One Final Word
You may “belong to a church,” you may be “trying to do the best you can,” you may be “striving to live right.” Your outward life may be the model of moral correctness, and you may be looked up to, honored, revered, and respected. Yet, if you have not been “born again” you are just as lost as if you had never heard of Christ. Yes, you may teach in the Sunday school, read the Bible, sing, shout, “feel happy,” and all the rest—but if you have never been “born again” you are still in your sins and a stranger to the Lord Jesus Christ!.
If you want to be saved from the wrath to come and from an eternity in Hell, and if you believe that Jesus Christ suffered, bled, and died on the cross for your sins, was buried, and rose again from the dead and you are willing to trust Jesus Christ with all of your heart so you can go to Heaven, please pray with me what is called the sinner’s prayer: Holy Father God, I acknowledge that I am a sinner and I admit that I have sinned against You and that I have broken Your Ten Commandments. I have lied before. I have stolen things before. I have lusted after people and things before. I have dishonored and disobeyed my parents. I have taken Your holy Name in vain. For Jesus Christ’s sake, please have mercy and grace upon my soul and forgive me of all of my sins, my failures, and my faults. As I now believe in Your Holy Son the Lord Jesus Christ. I believe that He suffered, bled, and died on the cross for my sins, was buried and rose again. Lord Jesus, please come into my heart and save my soul and change my life. Fill me with Your Holy Spirit and help me to repent of my sins past. Help me to turn from my old, evil life and follow You in the new life. For it is in Your Name I pray. Amen.
